Risk Evaluation / Corrective Action Program (RECAP)

 The Louisiana Department of Environmental Quality's Risk Evaluation / Corrective Action Program (RECAP) regulation was promulgated and became final on October 20, 2003. The minimum remediation standards established in this regulation for present and past uncontroled constituent releases are current and remain fully in effect. However, the regulation documents themselves have been archived.

Conveyance Forms

Conveyance notifications under the Louisiana Department of Environmental Quality’s Risk Evaluation and Corrective Action Program are required when institutional controls are required for site closure. Most commonly, when the residual contamination in soil exceeds non-industrial (residential) standards or when the residual contamination in a Groundwater 2 zone is acceptable for closure but remains too high to use the aquifer for drinking water. LDEQ provides the RECAP Conveyance Notice Form and several conveyance notice templates to reflect such site-specific conditions.

When the residual contamination in soils exceeds non-industrial (residential) standards, use the Conveyance Notice Format for Industrial Surface Soils.

When the contaminant levels present are acceptable for a Groundwater 2 zone but still exceed drinking water standards, use the Conveyance Notice Format for GW2.

When site-specific conditions include both of the above, use the Conveyance Notice Format for Industrial Soils and GW2 Zone.

Environmental Conditions Review 

An Environmental Conditions Review is the review of a report of environmental conditions at a specified tract of immovable property when the site investigation and report of findings are not required or requested by the administrative authority. An Environmental Conditions Review (ECR) is used to respond to Phase II Assessments and other limited site assessments if the constituents of concern (COC) concentrations detected are less than or equal to the non-industrial RECAP Limiting Screening Standard (LSS).
