                Section 185 of the Clean Air Act requires states with ozone nonattainment areas classified as severe or extreme to develop, as a revision to their state implementation plan, a fee collection rule to be implemented in the event that an area fails to attain the ozone standards by the attainment date. This memorandum provides additional guidance on fee collection programs for the 1-hour National Ambient Air Quality Standard, which are required by the anti-backsliding measures during the transistion to the 1997 8-hour ozone standard.
